Litigation today is global. Litigation also is like jello – push in one place, and things happen in other places. The point is exemplified by two recent developments. For one, consider antitrust litigation, now evolving and expanding in Europe, as a result of US courts cutting back on jurisdiction. For more of the specifics on the developments in Europe, consider this October 5, 2014 AmLaw article by Michael Goldhaber. For another example, consider a US federal judge now allowing assertion of English law claims in his US court, by overseas plaintiffs suing BP. The case is detailed in an October 6, 2014 article at D&O Diary.
