Garlock has grown to like North Carolina courts. The Belluck asbestos plaintiff’s firm, not so much. The result is what would appear to be a compelling motion by the Belluck firm to transfer to New York the RICO and state law fraud suit filed by Garlock against the Belluck firm for allegedly fraudulent actions by the Belluck firm in New York for lawsuits filed in New York. Legal Newsline has an October 31, 2014 story that provides pertinent specifics. Thus, the chess game goes on as Garlock tries to use one court in North Carolina to adjudicate all of Garlock’s complaints about state court asbestos lawsuits around the country. The outcome will be interesting.
